Terms of Service

1. Acceptance of terms

By creating an account, uploading a PDF, or otherwise using Access Lens AI (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

These Terms constitute a binding legal agreement between you and the operator of Access Lens AI, currently operated under the laws of Mexico.

2. Service description

Access Lens AI provides AI-assisted automated accessibility screening of PDF documents. The Service uses automated PDF structure analysis, standards-based validation, and AI-assisted report generation against WCAG 2.2, ISO 14289-1 (PDF/UA-1), the Matterhorn Protocol, and related standards, and generates a screening report of potential accessibility issues.

The Service is currently provided as a beta product under active development. Features, scoring methodologies, issue classification, report presentation, and automated screening workflows may evolve over time. Beta status does not change your payment obligations, but it means results should be independently reviewed before compliance, procurement, or legal decisions.

The Service is an automated screening tool only. It is not an accessibility certification. It is not a conformance assessment. It does not constitute legal advice. It is not provided by a law firm, an official accessibility certification body, or a recognized conformance authority. Results are indicative and require professional human review before any legal, procurement, or compliance decision is made.

Access Lens AI does not guarantee that every accessibility issue will be surfaced. Reports may contain false positives (issues flagged that are not actual failures) and false negatives (actual issues that were not surfaced). Results may differ from those produced by PAC, Acrobat Pro, CommonLook, standards validators, assistive technology testing, or a professional manual accessibility review. A clean report does not mean the document is fully accessible or legally compliant.

Certain malformed, image-based, corrupted, or structurally inconsistent PDFs may not support complete automated accessibility validation. In such cases, screening results may be partial, limited, or unavailable.

You are solely responsible for determining your legal obligations under applicable accessibility laws in your jurisdiction. Access Lens AI does not provide legal advice and is not a substitute for legal counsel.

3. AI limitations and accuracy

Access Lens AI uses automated PDF structure analysis, standards-based validation, and AI-assisted report generation to produce accessibility screening reports. You acknowledge the following inherent limitations:

  • Automated screening can surface many common accessibility issues, but manual testing is required to identify barriers that automation cannot reliably surface.
  • The Service may produce false positives (reported issues that are not actual failures) and false negatives (actual barriers not surfaced).
  • AI-generated explanations and remediation guidance are advisory only and may not account for all edge cases, document structures, or screen reader behaviors.
  • A clean report (zero issues surfaced) does not mean the document is fully accessible or legally compliant.

For legal or procurement compliance decisions, official certification, or responding to a formal accessibility complaint, independent expert review and testing are required.

4. Pre-purchase acknowledgment

Before purchasing a screening or subscription, you may be required to affirmatively acknowledge that the Service provides an automated accessibility screening report only, not a certification, legal opinion, official accessibility assessment, or guarantee of compliance with WCAG, PDF/UA, ADA, the EU Accessibility Act, Section 508, or any applicable law. We may record your acknowledgment, acceptance of these Terms, acceptance of the Privacy Policy, timestamp, version metadata, user account, and checkout/session identifiers as evidence of acceptance.

5. User obligations

By using the Service, you represent and warrant that:

  • You have the legal right to upload and process the PDF (you are the owner or have explicit permission from the owner).
  • The PDF does not contain illegal content, malware, or any material that infringes third-party intellectual property rights.
  • You should not upload highly sensitive personal data (such as health records, financial records, or sensitive personally identifiable information) unless it is necessary for the accessibility screening. You are responsible for redacting or anonymizing sensitive information in your documents before upload where appropriate.
  • You will not attempt to reverse-engineer, decompile, or extract the underlying AI models or proprietary logic of the Service.
  • You will not attempt to circumvent rate limits, quotas, authentication mechanisms, or any other technical controls.
  • You will not use the Service for any unlawful purpose or in violation of any applicable regulation.

6. Account

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@accesslensai.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.

7. Payment

All prices are in USD and are charged per screening based on page count: 1–10 pages $2.99 · 11–50 pages $7.99 · 51–100 pages $14.99 · 101–200 pages $24.99. Applicable taxes may be calculated and added at checkout depending on the customer's location, billing region, and applicable tax rules. Payments are processed by a third-party payment processor; by making a payment you agree to the processor's terms of service and privacy policy where applicable.

The Pro Monthly Beta plan ($49.99/mo) includes up to 50 PDF screenings/month during beta and up to 2,000 pages/month. Supports PDFs up to 200 pages each and 50 MB per PDF. Unused screenings do not roll over between billing periods. Fair use protections apply during beta operation. Additional usage may require a custom plan. The plan remains subject to reasonable use, rate limits, technical capacity, abuse prevention, and these Terms. We may throttle, suspend, or terminate use that is abusive, automated, fraudulent, or materially exceeds normal individual or business use. Your subscription automatically renews each month until cancelled. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.

Enterprise Workflows options are available by contact-based custom pricing. Available options may include confidential document workflows, priority support, configurable retention policies, optional rapid deletion workflows, higher-volume processing, procurement/security review support, custom screening volumes, and enterprise invoicing.

8. Refund policy

Pay-per-page screenings: No refunds are issued for completed screenings. When you initiate a screening, we immediately incur real costs for AI-assisted report generation, PDF analysis, and standards validation that cannot be recovered. By proceeding to payment, you expressly acknowledge and accept this no-refund policy for completed screenings.

Exceptions to the no-refund policy:

  • (a) Interrupted validation: If automated validation cannot complete due to unsupported or structurally inconsistent PDF architecture, Access Lens AI may provide a limited retry opportunity instead of issuing an automatic refund.
  • (b) Systemic technical failure: If a systemic technical failure on our side prevents validation from completing (e.g., server outage, data loss), we may provide a credit, retry opportunity, or refund where appropriate. Contact hello@accesslensai.com within 48 hours of the interrupted validation.
  • (c) Duplicate charges: If you were charged more than once for the same screening due to a payment processing error, the duplicate charge will be refunded in full.

Pro Monthly subscriptions ($49.99/mo): You may cancel at any time. Your subscription remains active through the end of the current billing period. We do not issue prorated refunds for partial months. There is no free trial.

Tool differences are not system failures: Differences between the results produced by Access Lens AI and those produced by other tools — including PAC, Acrobat Pro, CommonLook, standards validators, screen readers, or internal accessibility review processes — do not by themselves constitute a system failure or grounds for a refund. Each tool uses different screening methods, and no automated tool is expected to produce identical output to another.

Nothing in this refund policy limits any non-waivable consumer rights you may have under applicable law.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ACCESS AUDITOR AI DOES NOT WARRANT, GUARANTEE, OR REPRESENT THAT USE OF THE SERVICE WILL RESULT IN COMPLIANCE WITH WCAG, PDF/UA, ADA TITLE III, THE EU ACCESSIBILITY ACT, SECTION 508, OR ANY OTHER ACCESSIBILITY STANDARD OR LEGAL REQUIREMENT.

THE SERVICE IS NOT LEGAL ADVICE AND IS NOT AN ACCESSIBILITY CERTIFICATION, CONFORMANCE ASSESSMENT, OR OFFICIAL ACCESSIBILITY ASSESSMENT. NOTHING IN THE SCREENING REPORTS CONSTITUTES LEGAL ADVICE OR CREATES AN ATTORNEY-CLIENT RELATIONSHIP. ACCESS AUDITOR AI IS NOT A LAW FIRM, ACCESSIBILITY CERTIFICATION BODY, OR OFFICIAL CONFORMANCE AUTHORITY. PROFESSIONAL HUMAN REVIEW BY A QUALIFIED ACCESSIBILITY EXPERT IS REQUIRED BEFORE MAKING ANY LEGAL COMPLIANCE CLAIMS.

WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SERVICE.

WE DO NOT GUARANTEE THAT EVERY ACCESSIBILITY ISSUE WILL BE SURFACED. REPORTS MAY CONTAIN FALSE POSITIVES AND FALSE NEGATIVES. RESULTS MAY DIFFER FROM THOSE PRODUCED BY OTHER TOOLS INCLUDING PAC, ACROBAT PRO, COMMONLOOK, STANDARDS VALIDATORS, SCREEN READERS, OR A PROFESSIONAL MANUAL ACCESSIBILITY REVIEW.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACCESS AUDITOR AI OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Access Lens AI and its operator from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) content you upload or submit; (c) your violation of any third-party rights; or (d) your violation of any applicable law.

12. Intellectual property

The Service, including its software, algorithms, design, and documentation, is owned by or licensed to the operator of Access Lens AI and is protected by intellectual property laws. You may not copy, modify, or distribute it.

Your uploaded PDFs and screening reports remain yours. We claim no ownership over content you upload. We use it only to provide the Service you requested.

13. Privacy

Our collection, use, retention, deletion, and processing of PDFs, screening reports, account data, checkout acknowledgments, and payment references are described in the Privacy Policy. By using the Service, you agree to the Privacy Policy.

Original uploaded PDFs are stored temporarily for support, debugging, false-positive review, and operational validation during public beta, then automatically deleted shortly after processing or after temporary operational retention needs are complete. Accessibility screening reports and limited screening metadata may remain associated with your account history unless deleted by request, as described in the Privacy Policy.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, engage in abusive behavior, or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Data retention after termination follows the Privacy Policy.

15. Governing law and disputes

These Terms are governed by the laws of the United Mexican States, without regard to conflict of law provisions.

Before initiating any legal proceeding, you agree to attempt to resolve any dispute through good-faith negotiation for at least one calendar month by emailing hello@accesslensai.com.

If good-faith negotiation fails, any dispute shall be submitted to the competent courts of Mexico where legally available, except where consumer protection laws require a different venue or provide non-waivable rights.

16. Changes to these terms

We may update these Terms at any time. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

17. Export controls

The Service and its outputs (screening reports, AI-generated content) may be subject to export control laws and regulations, including U.S. Export Administration Regulations (EAR) and any applicable Mexican or EU export control laws. You agree not to access, use, download, or export the Service or its outputs in violation of such laws, including to any country, entity, or person subject to applicable sanctions or embargo.

18. Data loss limitation

We implement reasonable technical measures to safeguard your data, including encrypted storage and automated backups. However, we do not guarantee that data will never be lost due to hardware failure, software bugs, security incidents, or other unforeseen events.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACCESS AUDITOR AI SHALL NOT BE LIABLE FOR ANY LOSS OF DATA, LOSS OF SCREENING REPORTS, OR LOSS OF ACCESS TO YOUR ACCOUNT, WHETHER ARISING FROM NEGLIGENCE, BREACH OF CONTRACT, OR ANY OTHER CAUSE. YOU ARE ENCOURAGED TO DOWNLOAD AND RETAIN COPIES OF YOUR SCREENING REPORTS FOR YOUR OWN RECORDS. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUP COPIES OF ANY CONTENT IMPORTANT TO YOU.
